r <br /> system drainfield should suitable alternate sites not be found elsewhere on the lot either <br /> within the Fairfax County portion or Loudoun County portion of the lot. <br /> 5. All alternate drainfield site exploration and testing on the lot to determine site <br /> suitability will comply with Fairfax County Health Dept. regulations governing such <br /> testing, regardless of which county the area being tested actually lies within. <br /> 6. Should exploration and subsequent testing indicate that a suitable alternate septic <br /> drainfield site lies on the lot, regardless of its location or within which county the site lies, <br /> Fairfax County Health Department regulations will prevail with regard to all testing, <br /> recording and permitting of that site for construction on the lot. <br /> 7. Any septic drainfield constructed on the lot, regardless of its location or within which <br /> county it lies, will be permitted, inspected, constructed, governed and maintained by and <br /> to applicable Fairfax County Health Department and Commonwealth of Virginia laws, <br /> rules and regulations. <br /> 8. Loudoun County Health Department and Loudoun County hereby cede to Fairfax <br /> County any and all jurisdictional and regulatory control of any residential septic system <br /> which may be constructed on the lot pursuant to this agreement. <br /> 9. Fairfax County Health Department and Fairfax County hereby state that they accept <br /> jurisdictional and regulatory responsibility anu control for the construction of any <br /> residential septic system which may be constructed on the lot pursuant to this agreement. <br /> If this is an accurate statement of our agreement, please sign the enclosed copies <br /> (three) and return them to me. I will keep one signed copy for my records and will return <br /> one copy to each of you to become a permanent record of this agreement for your <br /> respective agencies files. Thank you both very much for your cooperation in this matter. <br /> Coming to this understanding early in the planning stages will allow me to proceed in a <br /> much more orderly fashion in planning for and eventually building on our lot.
